Revises section 6106 of Title 18 to not require a license to carry a firearm. Declares every person present in this commonwealth shall have an affirmative, fundamental and constitutional right to keep and bear firearms, including the right to carry openly or concealed, carry loaded or unloaded, train with, transport, possess, use, acquire, purchase, transfer, inherit, buy, sell, give or otherwise dispose of or receive any firearm or self-defense device without a license, permission or restriction of any kind from or by this commonwealth or any of its political subdivisions. Permits for an optional license. Repeals the prohibition of carrying firearms on public streets or public property in Philadelphia. Provides for sportsman’s firearm permit and issuance. Requires a form and permits fee collections. Provides a person who sells or attempts to sell a sportsman’s firearm permit for a fee in excess of the amount determined under this section to commit a summary offense. Defines the purpose of the license. Allows an applicant to make an application with the sheriff of any county if the applicant is not a resident of the commonwealth. Provides language for form statement. Provides for criminal background checks by the National Instant Criminal Background Check System and the license to be issued after an investigation not to exceed 14 calendar days, unless good cause exists to deny the license. Prohibits the issuance of a license to an individual who is not of sound mind or who has ever been involuntarily committed to a mental institution, unless the involuntary commitment has been expunged, vacated or granted relief from a prohibition to possess a firearm. Replaces “sheriff” throughout the bill with “issuing authority.” Repeals provision for proof of license and exception. Effective in 60 days.

Prohibits this section from being construed that PSP or other local law enforcement agency has the authorization to sell or transfer any confiscated firearms in PSP’s or other local law enforcement agency’s possession. Asserts that if PSP or other local law enforcement fails to locate the owner of a confiscated firearm within 120 days after coming into possession of said firearm, or if the owner is prohibited from possessing a firearm, PSP will destroy it. Allows PSP to destroy a confiscated firearm if reasonable efforts to locate the owner have failed. Prohibits firearms from being destroyed if they are being used as evidence in an ongoing litigation and asserts that firearms may be destroyed once litigation has concluded or if a court of competent jurisdiction authorizes it. Mandates firearms must be melted at smelting plants located within the commonwealth. Requires PSP to place confiscated firearms in sealed containers as well as keep and maintain a registry for cataloging all confiscated firearms within PSP’s possession. Provides specified information for cataloging the confiscated firearms. Asserts that confiscated firearms should be destroyed as soon as possible but no less than quarterly. Asserts that PSP may keep confiscated firearms until accumulating a sufficient number of firearms to defray the costs associated with this section, provided the firearms are destroyed within 180 days of coming into PSP’s possession. Removes the provision regarding a license not being issued to an individual whose character and reputation are such that the individual would be likely to act in a manner dangerous to public safety. Requires the Attorney General to seek to establish reciprocity agreements with every state and may not unilaterally withdraw from any reciprocity agreement. Requires the report concerning reciprocity agreement progress between states to detail the efforts the Attorney General has made to establish reciprocity agreements with other states, and for each state that the commonwealth does not have a reciprocity agreement with, explain the reason why an agreement could not be reached. Stipulates that an applicant denied these rights shall be entitled to attorney fees and costs in any action against the issuing authority to enforce this section. Effective in 60 days.

Summary: (PN 71) The Center for Gun Violence Research Act provides for the establishment and funding of the Center for Gun Violence Research to research gun violence in this commonwealth. Provides that the center shall be administered by a university selected by the governor with the mission of conducting dependent, non-partisan academic research on gun violence in this commonwealth and providing policymakers, including the General Assembly, the governor, state agencies and local governments, with scientific evidence to develop sound gun violence prevention policies and programs. Provides that proposals for the location and operation of the center shall be solicited through a request in which universities shall submit proposals in the form and time period as established by the evaluation committee established under subsection (e). Requires proposals to be opened in a manner that avoids disclosure of the proposal’s contents to competing offerors and an evaluation committee will be established to review all proposals and make recommendations to the governor as provided under subsection (h). Directs the center to work continuously with the governor, General Assembly and local governments to identify, implement and evaluate innovative gun violence prevention policies and programs and to conduct basic, translational and transformative research using scientific-based methods to develop and analyze gun violence prevention policies and programs and shall conduct interdisciplinary research. Adds that each state agency, county district attorney's office, local police department and county or municipal health department shall provide to the center, upon request, the data necessary for the center to conduct the research required under this act and biennially, the center shall submit a report to the governor and the General Assembly on the center's activities, including research projects completed during the prior two years, current research projects and other information the center deems relevant. Directs the center to maintain a publicly accessible website and post all of the center's completed research. Provides that the General Assembly shall annually provide an appropriation to fund the activities of the center. Allows the center to supplement the center's own research by awarding competitive grants to nonprofit organizations that conduct gun violence research to be awarded on scientific merit. Requires the university housing the center to, on an annual basis, submit a request for funding to the Office of the Budget for inclusion in the governor's budget proposal. Effective in 60 days.

Directs the attorney general or a district attorney to prosecute violations. Allows an affected party to bring a private action for a violation. Provides for grant funds and forfeitures. Requires the attorney general to defend a resident of this commonwealth who is prosecuted by the federal government for a violation of federal law that attempts to register, restrict or ban the ownership or purchase of a firearm, magazine of a firearm, firearm accessory or ammunition that is retained in this commonwealth. Requires PSP to establish a statewide registry of extreme risk protection orders and shall maintain a complete and systematic record and index of all valid ex parte and final extreme risk protection orders filed under subsection (b). Lists what the registry must include. Provides prothonotary duty and registry availability. Mandates an annual report to be compiled by the PSP. Asserts that foreign extreme risk protection orders have the presumption of validity in the commonwealth. Establishes immunity for entities from civil liability for good faith conduct. Summary: (PN 285) Amends Title 18 (Crimes and Offenses), in firearms and other dangerous articles, adding a section to provide for report of theft or loss of firearm; and imposing a penalty. Requires an owner or other person lawfully in possession of a firearm who suffers the loss or theft of a firearm to report the facts and circumstances of the loss or theft to the police department having jurisdiction where the loss or theft occurred within 24 hours of the discovery of the loss or theft. Outlines the information the person making the report shall provide. Directs the officer or police department receiving the report to forward notice of the loss or theft with the information obtained to the Pennsylvania State Police (PSP). Requires PSP to receive, collect and file the forwarded information. Adds that PSP shall cooperate with and undertake to furnish or make the information available to all law enforcement agencies in this commonwealth to coordinate law enforcement efforts to locate the firearms. Provides that a person who violates these provisions commits a summary offense punishable by a fine of not more than $500. Effective in 60 days.
