Directs DEP to review the Pennsylvania CO2 Budget Trading Program base budget established in 25 Pa. Summary: | (PN 1370) Amends Title 27 (Environmental Resources), providing for portable battery stewardship and establishing requirements for Battery Stewardship Plans; imposing duties on the Department of Environmental Protection; and imposing penalties. Requires each producer selling, offering or making available for sale or distributing covered batteries or battery-containing products in the state to participate in an approved State battery stewardship plan through participation in and appropriate funding of a battery stewardship organization beginning January 1, 2027. Prohibits the sale of covered batteries or battery-containing products without a certification that the retailer participates in a state plan. Adds that all covered batteries and battery-containing products must be marked consistent with the requirements before being sold. Establishes stewardship plan requirements for each battery stewardship organization. Provides review procedures by the department of the stewardship plans for compliance and outlines review requirements. Requires the submission of a new plan if there are significant changes to the methods of collection, transport or end-of-life management, to address the novel inclusion of medium format batteries as covered batteries under the plan or every five years. Allows for amendments and outlines the process. Requires quarterly notifications and allows for revised plans no earlier than five years after the approval of the initial approval of a plan. Establishes performance standards and plan content requirements. Establishes target requirements for each battery stewardship plan. Provides for funding, adding that each battery stewardship organization must ensure that adequate funding is available to fully implement approved battery stewardship plans, including the implementation of aspects of the plan addressing covered battery collection, transporting and processing, education and outreach, program evaluation and payment of the administrative fees to the department. Requires a battery stewardship organization implementing a battery stewardship plan to create a system to collect charges from participating producers to cover the costs of plan implementation and outlines responsibilities. Establishes collection and management requirements. Adds services and facility requirements to stewardship plans and outlines battery stewardship program requirements. Establishes education and outreach requirements, outlining promotional activity content guidelines, information requirements, provides for reimbursement and requires the provision by an organization to a producer of educational materials. Establishes reporting requirements and provides for confidentiality. Establishes fees for battery stewardship plan submissions and requires the department to determine the fee amount. Requires the department to implement, administer and enforce the chapter, including reviewing submitted plans, reviewing annual reports, ensuring public awareness and providing technical assistance. Provides for penalties and civil actions. Establishes marketing requirements for batteries, certification and amendment to requirements procedures. Summary: | (PN 1824) The Retail Establishment Bag Prohibition Act prohibits single-use plastic bags in retail establishments; and imposes duties on the Department of Community and Economic Development. Provides definitions. Prohibits a retail establishment from providing a single-use plastic bag or paper bag other than a recycled paper bag to a customer. Exempts individuals making a purchase through the use of a food instrument issued under the Pennsylvania Special Supplemental Nutrition Program for Women, Infants and Children (WIC) from the prohibitions and the fee established in section 5 (a). Establishes a signage requirement for retail establishments regarding the bag policy. Provides for the office to ensure that meaningful opportunities exist for the public to submit comments and recommendations relating to the environmental justice strategy under paragraph (8), to hold public meetings or otherwise solicit public participation from communities of color and low-income communities for the purpose of fact-finding, policy development, receiving public comments and conducting inquiries concerning environmental justice and to prepare a public review and publish a summary of the comments and recommendation.
