Revises section 6106 of Title 18 to not require a license to carry a firearm. Declares every person present in this commonwealth shall have an affirmative, fundamental and constitutional right to keep and bear firearms, including the right to carry openly or concealed, carry loaded or unloaded, train with, transport, possess, use, acquire, purchase, transfer, inherit, buy, sell, give or otherwise dispose of or receive any firearm or self-defense device without a license, permission or restriction of any kind from or by this commonwealth or any of its political subdivisions. Permits for an optional license. Repeals the prohibition of carrying firearms on public streets or public property in Philadelphia. Provides for sportsman’s firearm permit and issuance. Requires a form and permits fee collections. Provides a person who sells or attempts to sell a sportsman’s firearm permit for a fee in excess of the amount determined under this section to commit a summary offense. Defines the purpose of the license. Allows an applicant to make an application with the sheriff of any county if the applicant is not a resident of the commonwealth. Provides language for form statement. Provides for criminal background checks by the National Instant Criminal Background Check System and the license to be issued after an investigation not to exceed 14 calendar days, unless good cause exists to deny the license. Prohibits the issuance of a license to an individual who is not of sound mind or who has ever been involuntarily committed to a mental institution, unless the involuntary commitment has been expunged, vacated or granted relief from a prohibition to possess a firearm. Replaces “sheriff” throughout the bill with “issuing authority.” Repeals provision for proof of license and exception. Effective in 60 days.

Requires each school entity that has met the tier 1 baseline criteria for physical security established by the committee within one year of the effective date of this subsection to have at least one school armed guard in each school building, designate point or points of entry, and equip each exterior door of a school building that has not been designated a point of entry and exit with a clearly marked sign and audible alarm. Directs a school armed guard assigned to a school building to be present at all times in the school building during the school day and extracurricular activities that occur outside the school day in the school building. (PN 612) Amends Title 18 (Crimes and Offenses), in firearms and other dangerous articles, further providing for sale or transfer of firearms, for duties of the Pennsylvania State Police (PSP) and for the offense of altering or obliterating marks of identification and providing for destruction of confiscated or recovered firearms. Prohibits this section from being construed that PSP or other local law enforcement agency has the authorization to sell or transfer any confiscated firearms in PSP’s or other local law enforcement agency’s possession. Asserts that if PSP or other local law enforcement fails to locate the owner of a confiscated firearm within 120 days after coming into possession of said firearm, or if the owner is prohibited from possessing a firearm, PSP will destroy it. Allows PSP to destroy a confiscated firearm if reasonable efforts to locate the owner have failed. Prohibits firearms from being destroyed if they are being used as evidence in an ongoing litigation and asserts that firearms may be destroyed once litigation has concluded or if a court of competent jurisdiction authorizes it. Mandates firearms must be melted at smelting plants located within the commonwealth. Requires PSP to place confiscated firearms in sealed containers as well as keep and maintain a registry for cataloging all confiscated firearms within PSP’s possession. Provides specified information for cataloging the confiscated firearms. Asserts that confiscated firearms should be destroyed as soon as possible but no less than quarterly. Asserts that PSP may keep confiscated firearms until accumulating a sufficient number of firearms to defray the costs associated with this section, provided the firearms are destroyed within 180 days of coming into PSP’s possession. Effective in 60 days.

Establishes limits on the purchase and sale of handguns. Provides exceptions to the limits. Creates grading for violations. Requires disposition of fines collected by a court to the State Treasurer. Stipulates money in the Violence Prevention Account is to be appropriated on a continuing basis to the Pennsylvania Commission on Crime and Delinquency (PCCD) exclusively for purposes of violence prevention, including youth education and activities designed to prevent violence and grants to law enforcement agencies for equipment and training designed to prevent gun-related injuries. Requires a seller to notify each prospective purchase that the purchase of more than one handgun in a 30-day period is prohibited under this section and of the applicable penalties. Removes the provision requiring the sheriff to conduct an investigation of the applicant’s character and reputation in which the applicant will not be likely to act in a manner dangerous to public safety. Orders the sheriff to not keep or retain information relevant to the investigation beyond the initial application and proof of approval for more than 10 days beyond successful issuance or denial of license. Removes the provision regarding a license not being issued to an individual whose character and reputation are such that the individual would be likely to act in a manner dangerous to public safety. Requires the Attorney General to seek to establish reciprocity agreements with every state and may not unilaterally withdraw from any reciprocity agreement. Requires the report concerning reciprocity agreement progress between states to detail the efforts the Attorney General has made to establish reciprocity agreements with other states, and for each state that the commonwealth does not have a reciprocity agreement with, explain the reason why an agreement could not be reached. Stipulates that an applicant denied these rights shall be entitled to attorney fees and costs in any action against the issuing authority to enforce this section. Effective in 60 days.

Permits investigatory teams. Requires notice to the task force of any arrest involving violations of sections 6105 or 6111 within 48 hours of arrest or of instituting the action or proceeding. Permits preemptive prosecutorial jurisdiction by the Attorney General. List circumstances to consider for preemptive prosecutorial jurisdiction. Declares where the Attorney General may not assert preemptive prosecutorial jurisdiction. Requires annual reporting. The addition of 18 Pa.C.S. § 6129 is effective in 90 days. Adds that it shall be unlawful for a person to manufacture, import, sell, ship, deliver, possess, transfer or receive a firearm constructed entirely of a nonmetal substance, or a firearm that does not include at least one major component of a firearm constructed entirely of a metal substance, including a barrel, slide, cylinder, frame or receiver, which meets specified requirements. Stipulates that an offense under this subsection constitutes a felony of the third degree. Defines “major component.” Effective in 60 days.

Prohibits this act from limiting a nonpublic school from reporting a crime conducted by a child with a disability to the appropriate authorities. (PN 71) The Center for Gun Violence Research Act provides for the establishment and funding of the Center for Gun Violence Research to research gun violence in this commonwealth. Provides that the center shall be administered by a university selected by the governor with the mission of conducting dependent, non-partisan academic research on gun violence in this commonwealth and providing policymakers, including the General Assembly, the governor, state agencies and local governments, with scientific evidence to develop sound gun violence prevention policies and programs. Provides that proposals for the location and operation of the center shall be solicited through a request in which universities shall submit proposals in the form and time period as established by the evaluation committee established under subsection (e). Requires proposals to be opened in a manner that avoids disclosure of the proposal’s contents to competing offerors and an evaluation committee will be established to review all proposals and make recommendations to the governor as provided under subsection (h). Directs the center to work continuously with the governor, General Assembly and local governments to identify, implement and evaluate innovative gun violence prevention policies and programs and to conduct basic, translational and transformative research using scientific-based methods to develop and analyze gun violence prevention policies and programs and shall conduct interdisciplinary research. Adds that each state agency, county district attorney's office, local police department and county or municipal health department shall provide to the center, upon request, the data necessary for the center to conduct the research required under this act and biennially, the center shall submit a report to the governor and the General Assembly on the center's activities, including research projects completed during the prior two years, current research projects and other information the center deems relevant. Directs the center to maintain a publicly accessible website and post all of the center's completed research. Provides that the General Assembly shall annually provide an appropriation to fund the activities of the center. Allows the center to supplement the center's own research by awarding competitive grants to nonprofit organizations that conduct gun violence research to be awarded on scientific merit. Requires the university housing the center to, on an annual basis, submit a request for funding to the Office of the Budget for inclusion in the governor's budget proposal. Effective in 60 days.

Directs the attorney general or a district attorney to prosecute violations. Allows an affected party to bring a private action for a violation. Provides for grant funds and forfeitures. Requires the attorney general to defend a resident of this commonwealth who is prosecuted by the federal government for a violation of federal law that attempts to register, restrict or ban the ownership or purchase of a firearm, magazine of a firearm, firearm accessory or ammunition that is retained in this commonwealth. Establishes that the provisions of this act are severable. Effective in 30 days.

Explains that nothing in this chapter shall be construed to impose criminal or civil liability on any person or entity for acts or omissions related to obtaining an extreme risk protection order or ex parte extreme risk protection order, including, but not limited to, reporting, declining to report, investigating, declining to investigate, filing or declining to file a petition under this chapter. Provides for instructional and informational material. Requires PSP to establish a statewide registry of extreme risk protection orders and shall maintain a complete and systematic record and index of all valid ex parte and final extreme risk protection orders filed under subsection (b). Lists what the registry must include. Provides prothonotary duty and registry availability. Mandates an annual report to be compiled by the PSP. Asserts that foreign extreme risk protection orders have the presumption of validity in the commonwealth. Establishes immunity for entities from civil liability for good faith conduct. Prohibits a licensed importer, manufacturer or dealer from selling or delivering any firearm or ammunition to another person, with the exception of a gun range or target facility or, in the case of ammunition, a person who purchases or receives the ammunition at a gun range or target facility if the ammunition is kept within the facility's premises at all times. Provides details on remote ordering. Asserts that the provisions of section 6111(c) do not apply to transfers between siblings. Asserts that the provisions in subsections (a), (b.1) and (c) shall only apply to a firearm if the firearm is a pistol or revolver. Provides information required in the annual report by PSP. Outlines information regarding ammunition purchase authorization permits, including their use, validity, eligibility requirements, approval process, revocation, an internal centralized list of all permit holders, fees, permit number identification information and additional PSP regulations. Establishes the Ammunition Safety and Enforcement Fund. Provides details on transporting ammunition into the commonwealth. Asserts that section 6121.2 does not apply to a licensed importer, licensed manufacturer, licensed dealer, law enforcement agency or law enforcement officer or a grandparent, spouse, sibling, child or grandchild of the transferor. Effective July 1, 2026, or immediately, whichever is later.

Stipulates that a person adversely affected by any manner of ordinance, resolution, rule, practice or other action promulgated or enforced by a county, municipality or township in violation of subsection (a) or 53 Pa.C.S. § 307(a) (relating to regulation of firearms and ammunition) or 2962(g) (relating to limitation on municipal powers), may seek declarative and injunctive relief and the actual damages attributable to the violation in an appropriate court. Provides for court awards to claimants. Directs courts to award reasonable expenses payable by the county, municipality or township to the person if a defense results in a withdrawal or dismal of the proceeding, an entry of nolle prosequi or an acquittal on the basis of the defense. Defines “person adversely affected” and “reasonable expenses.” Asserts that the General Assembly has always intended and continues to intend to occupy the entire field of regulation of firearms, ammunition, magazines, accessories, firearm components and ammunition components. Preempts and supersedes any manner of ordinance, resolution, regulation, rule, practice or other action promulgated or enforced by a municipality of firearms, ammunition, firearm components or ammunition components in the commonwealth. The amendment or addition of 18 Pa.C.S. § 6120(a.4) and (b) is effective in 90 days. The addition of 53 Pa.C.S. § 307 is effective in 90 days. The remainder of the act is effective immediately.

Asserts that nothing in this shall be construed to limit eligibility for a resident hunter’s license under section 2702(b) (relating to residents). Establishes a native Pennsylvanian annual license, issued by the commission, and outlines what the issuance of a license shall be subject to. Specifies that the license may be issued to a nonresident who is either born in this commonwealth or has a living parent or former guardian who resides in this commonwealth. Asserts that the license shall cost the same as a resident license under section 2709 (relating to license costs and fees). Outlines guidelines for the current photo identification card and applicable documentation that an applicant must provide. Requires a first-time applicant for a native Pennsylvanian annual license to submit the application to the commission. Adds that a native Pennsylvanian annual license shall be identical to an annual resident license sold by the commission and shall be properly designated “native Pennsylvania.” Specifies that all regular annual licenses offered to residents shall be made available to an applicant who qualifies as a native Pennsylvanian, detailing that this paragraph shall not apply to a lifetime license. Asserts that nothing in this subsection shall be construed to limit eligibility for a resident hunter’s license under subsection (b). Explains that an applicant who provides a false written affirmation under paragraph (3)(i)(b) shall be subject to section 2711(a)(2) and (b)(3) (relating to unlawful acts concerning licenses) and 8 PA.C.S. § 4904 (relating to unsworn falsification to authorities).
