Prohibits a person or municipality from disposing of, processing, beneficially using or reusing certain residual waste by application, dumping, spreading or land application except for the land application of tophole water at a well site. Prohibits a vehicle used to transport certain residual waste from being equipped with a mechanism that allows the road spreading of the residual waste. Provides that certain residual waste proposed to be used or being used for dust suppression, road deicing or road bed stabilization shall not be considered a coproduct. Effective in 60 days.

Specifies that the department shall estimate the amount of money collected by the department beginning Jan. 1, 2014, and ending on the effective date, from an oil or gas lease under a publicly owned streambed in each county where such a streambed is located, outlining how money shall be distributed. Provides that the department shall distribute the money collected by the department after the effective date from an oil or gas lease under a publicly owned streambed to the county where the streambed is located. Asserts that a county that is the recipient of money shall use the money solely for maintaining creeks and streams within the county at the county’s discretion. Effective immediately.

Summary: (PN 302) The Subsurface Oil and Gas Lease Act provides for the leasing of subsurface rights on state forest and park property for oil and natural gas development; establishes a restricted account within the Oil and Gas Lease Fund; makes an appropriation; and abrogates an executive order and other orders and administrative policies. Provides definitions. Requires the Department of Conservation and Natural Resources (DCNR) to establish a program to review submissions or nominations by companies for the leasing of subsurface rights under state first and park property for oil and gas development. Outlines lease approval, resubmission upon disapproval and disapproval reason requirements. Requires DCNR to implement and post notices about the program within 90 days of the effective date. Provides for submissions and nominations and competitive bidding processes. Establishes the Oil and Gas Lease Fund, adding that all revenue generated from the leases shall be deposited into the fund. Adds that money in the restricted account is appropriated on a continuing basis to the department for the grant program. Outlines the grant program requirements including providing prioritization in awarding money to projects designed to mitigate the risk of flooding, projects that have the potential to preserve farmland or residential property from flooding and projects from areas of the state that have been under federal or state disaster emergency related to flooding in the last five years. Provides that a proposed project within a single county or municipality shall not receive more than 10% of the money under the grant program in a given year. Adds that the act abrogates Executive Order 2015-03 and any other order or administrative policy in conflict with this act. Effective immediately.

Revises the definition of “drill cuttings,” adds a definition for “exempt special waste” and amends to definition of “solid waste” to include drill cuttings from geological formations that contain oil or gas deposits. Adds that it shall be unlawful for any person or municipality who stores, processes or disposes of residual waste to fail to test leachate prior to discharge requirements in accordance with National Pollutant Discharge Elimination System requirements for chloride, bromide, sulfate and nitrate; test leachate prior to discharge for hazardous characteristics requirement for toxicity, corrosivity, ignitability and reactivity; or test leachate prior to discharge requirements for naturally occurring radionuclides, including uranium, thorium, radium and their decay products, potassium-40 and lead-210.polonium-210. Outlines testing requirements and processes. Establishes reporting requirements for facilities. Prohibits a person or municipality, for the purpose of storage, processing or disposing, providing or receiving residual waste that exceeds permissible levels.
